A 3-member town council governs the Town of Owensville. This council exercises the legislative function of the town.
The council acts as the de facto town executive also. There is no limitation on the number of terms a town council member may serve.
As mandated by ordinance, the council is elected from districts.
The salaries of the council members are set by ordinance as are all salaries and wages of town officials and employees (IC 36-5-3-2). The council chooses from its members a president who conducts meetings, performs various other executive functions, and is designated as the town executive (IC 36-5-2-7). The members fix the president’s term, but it cannot exceed the term of office for the council member. Council members must reside in the town and the district (precinct) from which they are elected. Their office must be forfeited if that residency is not maintained.
State laws govern the general powers of the council; the methods through which the powers are exercised are left largely to the council to determine by ordinance. The powers of the town council are, in most cases, those powers given to the town government generally. The town’s appointed officials may be numerous if the councils have chosen to create, by ordinance, any of the various boards, commission and authorities authorized by statute, but usually the major appointments are the town marshal and town attorney.
Elections are conducted when any council member and/or clerk treasurer have opposition; if there is no opposition, a Town Election will not be conducted and the current elected officials are reinstated. Water/Sewer customers are required to fill out an application for water/sewer service. With that application, a photo ID is required
Renters: A renter is considered as such if they do not own both the property and structure. There is a $150 deposit required at the time of connection. The deposit is fully refundable as long as the utilities are paid in full. The deposit will not be refunded until a final bill has been issued. Once the final bill is determined, the town has the right to deduct all charges owed from the deposit and refund the remaining amount. Landlords are sent penalty notices in addition to the tenant. This advises the landlord of the tenants standing with the town, as the landlord could be held liable for sewer service left unpaid. All unpaid accounts will be summoned to small claims court.
Owners: There is no deposit for persons owning both the land and structure. However the town will file a lein against the property for all unpaid sewer balances. All bills are mailed out on the last working day of each month. Meter dates are from the middle of the month to the middle of month (Ex: Jan. 15 to Feb. 15). These dates may vary a day or two each month.
All Bills are due by the 15th of each month unless the 15th falls on a holiday or a weekend then you have the next business day to pay. Any bills paid after the due date will have penalty added. Bills are subject to disconnection if not paid by the 29th of each month.
All water is metered. Sewer is charged based on the water reading. Meter readings are done approximately the 15th of each month. It will be a rare occasion in which a reading will be estimated. The Town does have a laptop which auto reads each meter when the laptop is in close proximity; therefore customers will not see any evidence of lid removal. The autoread system flags meters with leaks. Those leak notifications are passed on to the customer. The customer needs to try to find the leak as soon as possible to avoid a high bill. The Town does not adjust water bills for leaks.

Unlike cities, there is no statute establishing the position of the town attorney, nor requiring the appointment of a chief legal officer for the town. However, virtually every town has an attorney who represents the town and generally manages the town’s legal affairs, under the direction of the town council either as an employee or as independent contractor. The town attorney is the town’s primary source of legal advice and usually drafts ordinances and other legal documents. He or she represents the town in legal proceedings and serves at the pleasure of the town council. Compensation is determined by the council, just as it is for the marshal and all other town employees and officials. There is no statute governing the responsibilities of the town attorney, who represents the town in much the same manner as an attorney does any other client.
